For too long has the education sector been blind to the vast potential of technology, resorting to outdated approaches that stifle the modern-day student. As the AthenaLearn community grows ever-stronger, we pledge to introduce revolutionary technology to improve the experience of our current students and widen opportunities for the many students who are yet to experience our services. Our technological arsenal will include a brand new Pantheon app which will track student progress, mediate tutor-student interactions with our Athena AI, manage their educational experience and offer carefully tailored pathways to make the AthenaLearn experience ever-more ubiquitous. Along with this, we are developing groundbreaking algorithms which will enable us to perform unparalleled student analysis, paving the way for education’s brighter, data-driven future. 1. Services Provided 1.1 Tutoring Sessions – AthenaLearn provides one-on-one and group tutoring sessions, delivered online or in person, subject to tutor availability. 1.2 Subjects Covered – We offer tutoring for KS2, KS3, GCSEs, A-Levels, IB, university admissions (including Oxbridge preparation), entrance exams, scholarships, and interview coaching. 1.3 Session Format – Sessions are conducted via video conferencing platforms or in person where applicable. AthenaLearn does not provide physical premises for tutoring. 1.4 Learning Resources – Study materials may be provided at AthenaLearn’s discretion. Proprietary materials must not be shared or distributed. 1.5 Service Availability – AthenaLearn reserves the right to modify, discontinue, or restrict services at any time without liability. 2. Fees & Payment 2.1 Pricing – Tutoring fees vary based on subject, tutor expertise, and session type. All rates are confirmed before booking. 2.2 Payment Terms – Full payment must be made before sessions commence. AthenaLearn accepts payments via bank transfer or other approved methods. 2.3 Non-Refundable Fees – All fees are strictly non-refundable, except under circumstances outlined in Section 8 (Cancellations & Refunds). 2.4 Late Payments – If payment is overdue, AthenaLearn reserves the right to: • Suspend or cancel future sessions until payment is received. • Charge late fees where applicable 2.5 Price Adjustments – AthenaLearn reserves the right to adjust service pricing at its discretion. Any changes will not affect already purchased sessions. 3. Responsibilities of the Tutee (Student/Parent/Guardian) 3.1 Commitment – Students must: • Attend sessions on time. • Complete any assigned work. • Actively participate in the learning process. 3.2 Notification of Absence – If a session cannot be attended, the student must notify AthenaLearn at least 24 hours in advance to reschedule. 3.3 Behavior & Conduct – Students must: • Communicate respectfully with tutors and staff. • Not engage in any form of harassment, discrimination, or disruptive behavior. • Refrain from dishonest academic practices, including plagiarism and cheating. 3.4 Parental Responsibility – Parents/guardians booking tutoring for minors are responsible for ensuring compliance with these terms. 4. Responsibilities of AthenaLearn 4.1 Qualified Tutors – Tutors are selected based on academic excellence and teaching ability. However, AthenaLearn does not guarantee specific results. 4.2 Consistent Service Quality – Sessions are structured to maximize learning outcomes. Feedback is provided where appropriate. 4.3 Right to Substitute Tutors – AthenaLearn may change a tutor if necessary to ensure service quality, without prior notice. 4.4 No Academic Guarantees – Success depends on the student’s effort, and AthenaLearn cannot be held responsible for exam outcomes. 5. Cancellations & Refunds 5.1 Student-Initiated Cancellations – Sessions cancelled with at least 24 hours’ notice may be rescheduled, subject to tutor availability. 5.2 Missed Sessions – Sessions missed without prior notice will be forfeited, and no refunds will be issued. 5.3 Tutor Cancellations – If a tutor cancels a session, a replacement session will be arranged at no extra cost. 5.4 Refunds in Exceptional Circumstances – Refunds are only issued in extreme cases (e.g., proven medical emergencies) at AthenaLearn’s discretion. 5.5 No Refund for Dissatisfaction – Dissatisfaction with a session or tutor does not entitle the student to a refund. Requests for tutor changes will be considered on a case-by-case basis. 6. Liability & Indemnity 6.1 Limitation of Liability – AthenaLearn and its tutors are not responsible for: • Direct or indirect losses resulting from tutoring services. • Any academic outcomes, including grades, university acceptances, or test scores. • Any reliance on information provided during tutoring sessions. 6.2 Technology Issues – AthenaLearn is not liable for technical difficulties (e.g., internet disruptions) on the student’s end. Rescheduling may be offered at AthenaLearn’s discretion. 6.3 Use of Third-Party Platforms – Sessions may be conducted via Zoom, Teams, or other platforms. AthenaLearn is not responsible for security or functionality issues on these platforms. 6.4 No Solicitation of Tutors – Clients must not attempt to engage AthenaLearn tutors for private tutoring outside of our platform. Any violation may result in contract termination without refund. 6.5 Force Majeure – AthenaLearn is not liable for failure to deliver services due to events beyond its control, including but not limited to natural disasters, pandemics, power failures, or government restrictions. 7. Confidentiality & Data Protection 7.1 Student Privacy – Personal information is kept confidential and used only for service delivery. 7.2 No Unauthorized Recordings – Students may not record, distribute, or share tutoring sessions or materials without written consent from AthenaLearn. 7.3 Legal Compliance – AthenaLearn complies with GDPR and UK data protection laws. 7.4 Security Measures – AthenaLearn takes reasonable measures to protect student data but is not responsible for security breaches beyond its control. 8. Termination of Services 8.1 Student Misconduct – AthenaLearn reserves the right to terminate services immediately if a student engages in: • Harassment or abuse towards tutors or staff. • Disruptive or disrespectful behavior. • Unauthorized distribution of learning materials. • Dishonest academic practices (e.g., plagiarism, cheating). • Soliciting AthenaLearn tutors for private arrangements. 8.2 Tutor Misconduct – If a tutor engages in inappropriate behavior, AthenaLearn will investigate, and sessions may be reassigned or refunded at its discretion. 8.3 Termination by AthenaLearn – AthenaLearn reserves the right to discontinue services at any time. Any prepaid but unused sessions may be refunded. 8.4 Breach of Terms – Any violation of these Terms & Conditions may result in immediate termination of services without refund. 9. Intellectual Property Rights 9.1 Ownership of Materials – Any learning materials, worksheets, or resources provided by AthenaLearn remain the intellectual property of AthenaLearn. 9.2 Prohibited Use – Students may not copy, distribute, resell, or use AthenaLearn’s materials for commercial purposes. 10. Non-Compete & Non-Solicitation 10.1 No Private Arrangements – Clients and students agree not to engage AthenaLearn tutors for independent tutoring outside of AthenaLearn services. 10.2 Tutor Recruitment Restriction – Clients may not attempt to recruit or employ AthenaLearn tutors for a period of 12 months after the last tutoring session. 11. Governing Law 11.1 Jurisdiction – These Terms & Conditions are governed by and construed in accordance with the laws of England and Wales.
